BAILEY LAWSUIT BACK TO CIRCUIT COURT

A legal victory for 109th District State Representative Darren Bailey in federal court Monday. The lawsuit brought by Bailey against Illinois Governor J.B. Pritzger was sent back to Clay County Circuit Court. He had been granted a temporary restraining order against having to comply with Pritzger’s state stay at home order. But before a permanent injunction could be considered, the Illinois Attorney Generals Office moved the case to U.S. District Court. Bailey objected and U.S. Magistrate Gilbert Sisson found in favor of Bailey and sent the matter back. In his ruling, Sisson said that it would have been a case of judicial overreach to find for federal jurisdiction in a case involving state actors accused of violating state law.
