Associated Press reports indicate that that the lawsuit challenging the validity of the Illinois stay-at-home order will be transferred from state to federal court. Illinois Attorney General Kwame Raoul’s office stated in a court filing that the case is moving because it involves U.S. constitutional rights of free relegion and due process. The lawsuit was brought by 109th District State Representative Darren Bailey in Clay County Circuit Court. Judge Michael McHaney previously ruled that Bailey himself was not bound by the order. Bailey is attempting to broaden the ruling to make the order invalid for all Illinois residents.
